CHAPTER 1: OFF HIGHWAY VEHICLES

5-1-1: DEFINITIONS: 

The following words and phrases used in this chapter shall have the following meanings unless a different meaning clearly appears from the context: 

1. ALL-TERRAIN TYPE I VEHICLE: Any motor vehicle fifty two inches (52") or less in width, having an unladen dry weight of one thousand five hundred (1,500) pounds or less, traveling on three (3) or more low pressure tires, having a seat designed to be straddled by the operator, and designed for or capable of travel over unimproved terrain. 

2. ALL-TERRAIN TYPE II VEHICLE: 

   1. Any other motor vehicle, not defined in Utah Code Annotated 41-22-2(2), (11) or (22), designed for or capable of travel over unimproved terrain. 

   2. All-terrain type II vehicles do not include golf carts, any vehicle designed to carry a person with a disability, any vehicle not specifically designed for recreational use, or farm tractors as defined under Utah Code Annotated 41-1a-102. 

3. MOTORCYCLE: Every motor vehicle having a saddle for the use of the operator and designed to travel on not more than three (3) tires. 

4. OFF HIGHWAY VEHICLE: Any "snowmobile", "all-terrain type I vehicle", "all-terrain type II vehicle" or "motorcycle", as defined in this section. 

5. SNOWMOBILE: Any motor vehicle designed for travel on snow or ice and steered and supported in whole or in part by skis, belts, cleats, runners or low pressure tires. 

5-1-2: APPLICABILITY: 

This chapter applies to all streets and highways within the corporate limits of the town of Hanksville. 

5-1-3: DESIGNATED STREETS: 

Pursuant to Utah Code Annotated 41-22-10.3, as amended, all streets in the Town are hereby designated as open to off highway vehicle use, except Highway 24 and Highway 95. 

5-1-4: STATE RESTRICTIONS APPLICABLE: 

Persons using off highway vehicles in the Town must comply with all other restrictions set out in Utah Code Annotated 41-22, including, but not limited to, registration, compliance with traffic laws, vehicle equipment, protective gear, licensing, etc.  

5-1-5: PROHIBITED ACTS AND ACTIVITIES: 

1. The speed limit for all off highway vehicles is fifteen (15) miles per hour. 

2. All off highway vehicles must ride on designated streets and roadways and not on the shoulder.

5-1-6: PENALTY: 

Any violation of this chapter may be subject to penalty as provided in section 1-4-1 of this code.
