All property owners within the subdivision have been notified of this change of the turn-round and boundary line and are in agreement with the changes. He has also made provision of a right-of-way for any future utility needs. This meets the current subdivision ordinance requirements.   Motion to approve the change in the Hanksville 1st Subdivision property line at the end of 80 south as shown on the submitted map: C. Eric Wells; Sec: Robert Gilner Aye: All in attendance. Report of Officers: Council member Mona Wells:   She has scheduled Founders Day for Saturday, October 11th and contacted the county for a free dump at the landfill.  The dump will be open from 10am  until 5pm. Reminder that no tires or used oil is accepted.  If someone needs help with a big item contact the clerk to coordinate with C. Mona Wells for pick-up.   Council member Morgan Stephens: ABSENT          Slate Banner has a fix-it list for the affordable housing units that he will be submitting to the clerk.  The eviction notice was sent to apartment #2 as per instructions by the council at the last meeting.  Tyson Hunt - asked if he could speak to why he was unable to pay. He had back surgery then his child was bit by a dog and it's been a rough few months for him.  He does realize that he has been late several times in the past.  The mayor would like to discuss this in an executive meeting.   C. Eric Wells requested money to spend on more Christmas lights to decorate the old church.  The council agreed that he could spend between $500 to $1000 for Christmas lights. Council member Eric Wells: A new sewer and water line has been installed for Red Desert, this is a 3” water line so bigger than most.  Maintenance will be working to connect Scott Livingston and Kenny McCoy property soon.  All have paid the required connection and impact fees.  They will be billed for the actual cost of materials including digging under the road by CC Construction, as required to get the utilities to the proper side of the road to connect.      The State approved a grinder pump from the extra money from the sewer project.  Also, the Wayne County Fire District is in need of information from the town regarding an ISO Audit that the county is undergoing..  Brennen Rees with Ensign said he could help with that but will need a little information from Eric. Brennen Rees - reported on the water master plan that he has been working on.  There had been some revision to the storage requirements needed for reserve after looking at the businesses they have determined the 300,000 gal storage will be required for emergency use with 100gpm for peak demand.  Hanksville has 260gpm from source wells but is deficient in water storage.  The oldest tank on the Rookie hill has had some leakage and they estimate by 2030 that tank will need to come offline.  Their recommendation is a new tank of 500,000 gal that will serve for the 40 year master water plan.  Brennen will finalize the maps and full water master plan.  This grant for the master plan will pay 100% of the cost and is needed before the town can continue to pursue the grant money from Rep. Celeste Molloy’s office for a bigger tank.   Council member Robert Gilner: He is ready to begin the road project and will get with Eric Wells and volunteer to make it happen.  The mayor met with Jared from UDOT. Eric Wells brought up the ongoing negotiations for a new (used) mini-ex.  He has found a mini-ex for $90K plus the trade-in valve of the current mini-ex will be $50K left plus he needs a trailer for it.  He also would like to propose the purchase of a used tractor for about $40K.  The mini-ex will be purchased from money received in the water fund for bulk water and the continued sale of bulk water to the construction crews for the diversion project will fund the purchase of a tractor.  This tractor will serve the needs of road maintenance, arena maintenance, utility install and general maintenance.  The bigger mini-ex will serve the needs of all sewer and water connections as well as the cemetery needs. Clerk Lisa Wells: Bills presented to council for approval (spreadsheet attached) Motion to approve bills: C. Eric Wells; Second C. Mona Wells. • September 4, 2025 - Hanksville Town Council

The Hanksville Town Council convened its regular meeting on the 4th day of September 2025 in the Hanksville Community Center; meeting commenced at 6:25pm.(started late due to waiting for a quorum to be present) Present: C. Robert Gilner, C. Mona Wells and C. Eric Wells Absent: Treasurer Jessica Alvey, Mayor Jeffren T. Pei, and C. Morgan Stephen Employees: Clerk Lisa Wells  Public in Attendance:   Slate Banner, Katherine Roberts, Sue Fivecoat, Sarah Tal and Sandy Borthwick.  Brock Jackson with R6 attended virtually. Meeting to Order:  C. Mona Wells Pledge:  C. Mona Wells Prayer: C. Eric Wells Roll Call: C. Mona Wells    Motion to approve minutes from the August council meeting:  C. Eric Wells; Second C. Robert Gilner Aye: All in attendance.   New Business:    Color Country Animal Welfare report from Sarah Tal and Sandy Borthwick - board members of CCAW - They are a non-profit organization established since 2009.  This is the 3rd year in their new facility in Torry.  They do animal rescue, adoption and animal boarding.  They also have a pet food bank where people can receive food for their animals at no charge.  They continue to spay/neuter and hold vaccine immunization clinics.  They are asking the town to donate $1000 or whatever the town would like at their next budget funding meeting.    Brock Jackson - R6 - Informed council of an on-going conversation that has started regarding annexation coordination with Wayne County and municipalities within it.  The idea is to create a buffer zone within 600’ of town boundaries that would require any new development within this buffer zone to get a letter of denial regarding annexation of the project before they would get approval from the county.  This would be a courtesy giving towns the first right of refusal to annex; they could choose to annex the property.  The county currently has a moratorium for any subdividing of more than 4 lots.  Brock is visiting with all the municipalities within Wayne County to see if they would like to implement this or something like it.  The council would like to continue this conversation. Public Comment:   Katherine Roberts - She has talked to Jabe at the BLM office regarding land swap of BLM property to be used for the public.  She mentioned that perhaps he could be invited to a planning commission meeting or council meeting.  Sue Fivecoat gave examples of this land swap happening with the BLM and Hanksville for recreation and public services such as the Hanksville park, cemetery and gun range.  As long as the property continues to be used as a benefit to a public need. A resource management plan in 2008 earmarked property that could be swapped.     Katherine then read a letter she has written (attached to minutes) titled “The Divisiveness and Cost of Unmoderated Social Media Platforms” and submitted to the council.  She is asking the town council to consider creating an official town forum on the town website that is moderated with clear policies to discuss official town business, including planning and zoning discussions.  She believes that the Hanksville Pickler has become an unofficial public forum that exposes the town to legal scrutiny, particularly concerning the First Amendment rights of constituents and other relevant laws concerning transparency and public access. The council discusses this issue at length and will table this request and do their best to research better avenues for public discussion in the future.   Slate Banner - His opinion regarding the request for money from Color County Animal Welfare, all tax money should be used for the town, not a non-profit organization. Report of Officers: Council member Mona Wells:   With cooler weather she is hoping to do work at the cemetery. Council member Morgan Stephens: ABSENT Council member Eric Wells: He continues to have conversion regarding the left over money from the sewer project.  They will not fund equipment or clean the sewer lines from flood damage.  He is looking for a grinder pump screen at the sewer flume. Public education regarding products that clog the sewer lines would be helpful.  He is also building cement forms at the park to be ready for any surplus cement from Brown Brothers. Council member Robert Gilner: He is still planning on doing the crack seal this fall on town roads but did not give a date. Mayor Jeffren T. Pei: ABSENT Treasurer Jessica Alvey: ABSENT Planning Commission:   Slate Banner - The planning commission will not be meeting in September.  SB174 update for subdivision application is complete and under final review.  They are comparing the new version to the old version to make sure everything is transferred over correctly. The P&Z would like the town council to consider 2 new changes: -A civil engineering review on behalf of the town be required. -Implementation of a 30 day deadline for recording of final plat with Wayne County Recorder’s office once it has been approved.  Failure to file with the county nullifies the application. Clerk Lisa Wells: Bills presented to council for approval (spreadsheet attached) Motion to approve bills: C. Robert Gilner; Second C. Mona Wells. Aye: All in attendance. Audit by Kimball & Roberts will be October 1, 2025 A resolution to cancel the council member race due to non contested race will be on the agenda for next council meeting. Apartment #2 tenants have failed to pay for 3 months, which has been their history.  What is the recommendation of the council for these tenants?  The council agreed to send an eviction notice to these tenants due to lack of payment for past due rent. dj Tabled Business:      Hanksville 1st Subdivision property line change - Slate Banner - He has several quit claim deeds to change property ownership to make the turnaround on his property smaller.  As per the engineered drawing presented it will be reduced to 100’ diameter, but this will require property ownership to change between Hanksville Town, Slate Banner and Sue Fivecoat.  The right-of-way for utilities will continue underground.  The council would like the planning commission to review this project and make sure it is in compliance with the planning and zoning regulations. Motion to adjourn:  C. Eric Wells; Second C. Robert Gilner. Aye: All in attendance. The meeting adjourned at 8:07pm.

Tabled Business:   Brennen Rees and Jack Jeppson with Ensign Engineering reported on their progress in updating the water master plan.  The most recent water master plan is from 2015 and for any funding to make improvements or upgrades a current water master plan must be in place.  The water master plan provides a guide and an overview of 3 items: Source - Hanksville has 3 wells  Storage - Hanksville has 2 storage tanks - 100,000 and 200,00 Distribution - reviews the current pipe size, meters, fire hydrants, etc. Ensign has calculated the equivalent residential connection (ERC) for Hanksville and is checking with the council for their input regarding the fire suppression guidelines from the Wayne County fire department and should increase storage capacity by raised for fire protection.  The master plan also projects 10 to 10 years out with census data used for growth to calculate the future needs of Hanksville.  They will continue to refine this report and in future town council meetings officially present this water master plan.  Brennen will email his draft to the clerk so council members can review it prior to council meeting. UDOT Safe Routes to School report - Brennen has completed a survey and will contact UDOT to get the project going with the design phase and then out to bid for the sidewalk starting at 100 east and turning up center to Hanksville Elementary.  This grant application was submitted for FY 2025 but was kicked down the road and was resubmitted for FY2026.  The mayor received confirmation that Hanksville was awarded the funding from Rep. Celeste Maloy’s office.  He will forward the information to Brennen so he can follow up with this project. C. Robert Gilner would like to get input from Ensign Engineering on a project to consider the storm water drainage for Hanksville, he wants to address this issue since Bull Creek is the only drainage option and there has been flooding with insufficient drainage..  Brennen Rees said he will look at funding options for a project like this, and he would start with a storm water master plan. New Business:  None Public Comment:  .Sara Brandbury - She is concerned about Brown Brothers Construction and their water usage.  She believes they will need over 300gpm to clean their gravel or their other construction needs for the Hanksville Diversion project.  The council will find out their anticipated water usage. Doug Roberts - Hanksville has a generator proved by Garkane, why didn’t it get put into operation earlier during this long power outage?   Slate Banner - He would like to know why the generator didn’t work, how come Hanksville isn’t being taken care of and would the council address Garkane and get answers about the generator. Mayor Pei- What can Hanksville do to provide for our own power needs? He has approached Bishop Duke Alvey about getting a generator to operate the Church of Jesus Christ of Latter-Day Saints building located in Hanksville in case people need a cool place to reside.  He has also contacted the Wayne School District regarding the Hanksville Elementary building about a generator to operate that building in case of power outage and a place of refuge for citizens. Ashton Brian - Hanksville could compile an emergency checklist and a central place for information to be shared to inform the public about the emergency and to conserve power.  Possibly an Emergency Management Plan for the community.  The council agreed that is a great idea. Motion to adjourn:  C. Robert Gilner; Second C. Morgan Stephens. Aye: All in attendance. The meeting adjourned at 7:20pm.

New Business:  None Public Comment:  Slate Banner - Presented his plan to make the turn around spot on 80 S that ends at his property smaller than is outlined on the subdivision map.  He has contacted all residents who live on 80 S so make them aware of his request.  Because the boundary line of the turnaround is in the subdivision he had to make a new subdivision boundary line (See attached pictures to the minutes).  He will get on the agenda for approval of his plan at the next council meeting.
